Judge Rules In Favor Of City In Dillard's Dispute

The city of Longmont has won a long-running battle against retailer Dillard’s.A Boulder County District Court judge Monday night ruled in favor of the city’s Urban Renewal Authority, granting them the title to the Dillard’s property at the blighted Twin Peaks Mall.

The city and the developer had been at odds for more than a year with the anchor store, which had an agreement that allowed it to veto any changes to the mall. Dillard's had argued that it could remain open during the renovation, prompting the city to file for condemnation of the property.

Monday's ruling paves the way for the planned $80 million redevelopment project to move forward.

An eminent domain trial will be held to set a price for Dillard’s. The date for that trial has not yet been set.
